She dismissed tRump from the case because "immunity for official acts", but creating a new agency is not an official act of the president.

So true! Trump was acting outside of official duties.

Creating a new agency may not be an official act - but it is an overreach or unconstitutional act. I like your thinking on this one. It should be thought through - if trump does something unconstitutional or illegal as president that is not part of his “official acts” - which those two things are not - then doing illegal and unconstitutional acts would fall outside of his immunity. I’d like to see someone take that one and make it clear that illegal and unconstitutional acts by a president are unofficial and therefore prosecutable and punishable.

Cool thinking! 👍👍

That is what Jack Smith was doing at the end of 2024.

Besides, the immunity ruling is not a blanket immunity. It says very carefully that SCOTUS would have to decide case by case, so I say give them something to chew on instead of letting him off the hook.

Justice Clarence Thomas:

“By keeping the ability to create offices out of the president’s hands, the Founders ensured that no president could unilaterally create an army of officer positions to then fill with his supporters.”

This is music to my ears. Let the depositions begin. I've been carrying a sign at Tesla protests that says "Depose and Deport Elon Musk ".

Thanks Popok, and to Judge Chutkan for her ruling on this case! Let’s get those depositions going and have Muskrat deposed, convicted, fined (use the monies to build a super-max) and jailed in it. I don’t feel that deportation would be a good choice, as it would still allow him to continue his behavior of destruction. Now that he has left the administration to focus on his personal businesses is why this suit was finally brought to light. Thanks for the expert explanation for us non-lawyers, and keep us updated!

This is indeed great news. However, an International War Crimes Tribunal, through NATO, has drawn up documents charging Trump and his henchmen with illegal operations that will ultimately imprison international peoples, as well as US citizens in an authoritarian/oligarchial regime. The issues we all are dealing with are SO MUCH bigger, and in many ways covert, than what we are fighting right now here in the US. We all need to realize the scope of this take-over and prevent it world-wide by effectively shutting it down. It involves all the modern amenities, which can be horror monstrosities, e.g., AI, computer hacking, psychological brainwashing, etc., etc. All of these operations, and more, are currently being used against US citizens.

For those who are unaware, I learned from an interview that Anand Giridharadas (The Ink) had with Karen Hao about AI, that there is a provision in the "The Big Ugly Orange Bill" that the House just pushed through and has gone to the Senate, to Block The States From Any Regulations Of AI For A Period Of 10 YEARS. Only the Fed. Gov would have the authority to make ANY regulations during that time. Have you any idea how much destruction of our constitutional government could be done in the remainder of of the current regime? We must deluge the Senate with letters and phone calls in opposition!

The measures in this Big Ugly Republican bill are unconstitutional, just like so much else that now is happening. But, what this really means is that we don’t have to adhere to any passed bills or executive orders that are unconstitutional. The sad thing is that most people probably won’t realize this. We’ve never been through something quite like this before.

Creating a new agency is beyond the pale of "official duties". How could she dismiss the key figure in this takeover of our democratic govt by a tyrant? I see some agree with me below. Spot on.

It increasingly seems that, despite considerable effort and numerous structured opportunities to prevent it, we are now left with only the court that trump himself engineered.
